The terms of this Agreement may only be modified with the written consent of the parties. If you are an authority or entity of the United States Government (“Government”), the Strata Service is made available exclusively for end use by the Government, in accordance with the provisions of the Federal Acquisition Regulation (“FAR”) and its additions, including the Department of Defense (“DoD”) FAR Supplement (“DFARS”), described in this section.
The Government`s technical data and software rights in the Services include only those rights ordinarily made available to the public under this Agreement. This commercial license is provided in accordance with the provisions of far §12.211 (Technical Data) and FAR § 12.212 (Computer Software) and for DoD DFARS § 252.227-7015 (Technical Data – Commercial Items) and DFARS § 252.227.7202-3 (Rights in commercial software or computer software documentation). If the government needs rights that are not transferred under these terms, it must negotiate with Strata to determine whether there are acceptable terms for the transfer of such rights and a mutually acceptable written endorsement, which specifically transfers those rights, must be included in any applicable contract or contract. . . .
